Employee Misclassification

Under California law, employers are required to pay employees at least the minimum wage for all hours worked. Both state and federal employment laws also require employers to pay employees overtime for working more than a specified number of hours per day or hours per week.

Some employees are "exempt" from minimum and overtime wage requirements. These employees include executives, managers, certain administrative workers, professionals and outside salespeople. However, it is not unusual for employees to be incorrectly classified as exempt by employers hoping to avoid paying minimum wages and overtime.
